In the light of a judgement from Scania and Blekinge Court of Appeal, case B 3209-20, the Swedish Government has decided to implement changes in the regulations concerning foreign hauliers' freight transport in Sweden.
The changes take effect December 1, 2021 and are briefly as follows:
(i) the Swedish Transport Agency's updated guidance on cabotage transports can be applied as national implementing regulations regarding cabotage transports. According to the updated guidance 1 cabotage transport can include several loadings and unloading places.
(ii) the criminal liability of the purchaser of an illegal cabotage transport is extended and takes effect as the illegal transport initiates and not, as before, when the transport in question "had been performed".
(iii) the penalty fee for violations of the cabotage rules is increased from the current SEK 40,000 to SEK 60,000, which is the highest penalty fee for unauthorized cabotage transports within the EU.
